    WASHINGTON / RankWire.AI / – Democracy Defenders Action and Transparency International U.S., as ethics watchdog organizations, have urged Congress to implement stringent anti-corruption measures within upcoming cryptocurrency legislation or to abandon the CLARITY Act altogether. In a joint statement, these nonpartisan groups criticized the ethical provisions in the proposed Digital Asset Market Clarity Act, highlighting significant loopholes present in its current form. They emphasized that without firm restrictions on self-dealing by public officials, the bill fails to protect American consumers, safeguard the national economy, or secure the crypto market.

    Legal professionals from both watchdog organizations pointed out that the ethics language included in the Senate draft was narrowly crafted and contained major statutory exemptions. The advocacy groups stated that the draft allowed existing cryptocurrency holdings and financial arrangements to remain unaffected, while lacking robust enforcement tools. They argued that this legislative language effectively shields pre-existing commercial ventures from federal oversight. To promote meaningful reform, the watchdogs called for a comprehensive ban that prevents all covered government officials from holding direct financial interests, engaging in digital asset trading, or earning revenue from pre-existing licensing and profit-sharing agreements.

    The coalition of advocacy groups outlined essential policy measures needed to stop public officials from exploiting federal oversight of digital assets for personal financial gain. They proposed that officials covered under the standards, along with their immediate family members—including spouses and dependent children—must divest from all digital asset holdings outside of diversified registered investment funds. Additionally, they called for strict regulations preventing adult children of public officials from leveraging familial relationships or proximity to power to promote commercial crypto ventures. The organizations stressed that full financial transparency must cover all digital asset transactions, including acquisitions, sales, and transfers, regardless of the form of remuneration involved.

    Senate CLARITY Act Provisions Under Scrutiny for Potential Loopholes

    Regarding enforcement, the oversight groups stated that ethics rules need an independent administrative authority to remain effective beyond a president’s term. They urged Congress to empower the Attorney General with investigatory authority under a longer statute of limitations and to allow private entities and state attorneys general to pursue legal actions against misconduct. Virginia Canter, chief counsel and director of ethics and anti-corruption at Democracy Defenders Action, explained that ethics legislation lacking independent enforcement mechanisms essentially provide a free pass for corruption, calling on Congress to push for a complete ban on digital asset interests for officials and their families.

    Policy analysts and economic experts noted that the broader debate around the CLARITY Act centers on establishing clear regulatory authority over the digital asset industry. The legislation aims to clarify the roles of federal market regulators, moving away from enforcement-centric approaches. However, ethics advocates underscored that public trust depends on strict boundaries separating regulatory authority from private financial interests. Scott Greytak, deputy executive director at Transparency International U.S., pointed out that the public expects officials to choose between regulating the industry or profiting from it. He emphasized that lawmakers must close the crypto conflict of interest loopholes or consider scrapping the CLARITY Act entirely to maintain government integrity.

    Calls to Remove Grandfather Clauses for Existing Investments Increase Pressure

    As the Senate reviews the bill, congressional leaders face mounting pressure from ethics organizations to address the conflict-of-interest safeguards. Oversight specialists warn that allowing exemptions for pre-existing commercial ties sets a dangerous precedent for enforcement of federal ethics in emerging financial sectors. Representatives from both advocacy groups reaffirmed that eliminating these exemptions is the minimum required to restore public confidence in federal market regulation.

    The fate of the CLARITY Act hinges on whether committee negotiators include binding ethics provisions before a final vote on the floor. Reports from congressional aides indicate ongoing bipartisan negotiations over potential amendments to enhance enforcement mechanisms. Ethics advocates cautioned that passing the legislation without comprehensive prohibitions on conflicts of interest would damage the credibility of regulatory efforts and perpetuate issues of corruption within the federal government.
